Department of Ed Restoring Title IX in Schools
The U.S. Department of Education has rescinded portions of several Title IX resolution agreements from prior administrations, arguing they were based on an unlawful interpretation that extended protections to “gender identity” rather than sex.
This action lifts requirements on schools related to issues like preferred pronoun use and policies protecting students who self-identify as transgender. Department is seeking to restore the law’s original meaning.
LEGAL ALERT for ACPeds Health Professionals in CA, CO, MI & NY
New legal developments could affect ACPeds members in California, Colorado, Michigan, and New York. In all four states, either the state attorney general or a state trial court has taken the position that declining to offer interventions like puberty blockers, feminizing medications (e.g. spironolactone), cross-sex hormones, mastectomies, or other surgical procedures to patients who identify as transgender could subject the physician or health professional to liability for gender-identity discrimination if the provider offers those same interventions for other purposes.
This mandate to provide sex-rejecting interventions could be relevant to pediatric practices that offer these interventions for legitimate medical reasons. For example, pediatric endocrine practices that offer puberty blockers to treat precocious puberty, or pediatric specialist practices that prescribe spironolactone to manage high blood pressure, or acne in female patients could possibly be threatened with a lawsuit by transgender-identifying patients who are denied those medications for sex-rejecting purposes. However, this mandate and/or patient expectation violates your right of conscience.
If you believe your practice may be affected, Alliance Defending Freedom is available to speak with you and can help connect you with attorneys who can advise on your legal obligations and available options.

AMA Continues to Support Sex-Rejecting Interventions
In a March newsletter, the American Medical Association (AMA) clarified that it continues to support sex-rejecting interventions for minors and that its policy is unchanged. Following a recent meeting with representatives from several organizations, including the Department of Health and Human Services (HHS) and the American Society of Plastic Surgeons (ASPS), the AMA reaffirmed its support for these interventions despite increasing evidence documenting the harms of chemical and surgical sex-rejecting treatments.
In contrast, the ASPS released a statement after the meeting expressing opposition to such procedures. For many years, AMA has supported sex-rejecting interventions, advocating for medical organizations and insurance providers to adopt their policies.
