Dear friends,

Yesterday the U.S. Department of Education opened a formal investigation into the public schools of Northborough and Southborough — the district that secretly transitioned Joseph and Arlene Kutzko’s daughter Sophie and then helped set in motion the cascade that took her from their home.

This development is highly significant. The federal government is using its resources to investigate whether this district violated the Federal Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PRPA): whether parents were denied their child’s records and whether school officials facilitated the “gender transition” of their daughter without the parents’ knowledge or consent.

For the Kutzkos personally, it’s even more powerful. Remarkably, the federal government, rather than being the problem, is now offering its help.

They have earned that assistance the hardest way possible. A counselor saw Sophie after school while the school told the parents she was getting math help. The school began using a male name and pronouns for their daughter without telling the parents.  Then DCF took Sophie. Abuse allegations that DCF itself found “unsupported” within weeks have been used to keep these parents from their daughter. They have not seen their daughter in over a year and a half.

The most frequent question we have been asked in the last few days is, “Are the Kutzkos okay?” The best answer I can give is that they remain resolute. They have spoken out, at risk to themselves, because they know the nightmare their family has endured is not unique to one high school in Massachusetts.

A federal investigation of the school district does not block the testosterone or bring Sophie home. But it does mean Washington is looking into the starting point of the Kutzko’s nightmare – the school system where excluding the parents began.

The Kutzkos are still fighting in Worcester Juvenile Court trying to stop DCF from harming their daughter with hormones and to bring her home. And they still have to fight on a second legal front to have a permanent restraining order supported by DCF lifted. Legal bills have mounted to over $150,000 dollars.
