ACPeds and Do No Harm Applaud Introduction of the TRUTH in Coverage Act to Protect Patients Seeking Restorative Care Following Sex-Rejecting Procedures
Washington, DC — Today, Representative Diana Harshbarger (R-TN) introduced the Treatment and Restoration Uniformity and Transparency in Health Coverage (TRUTH in Coverage) Act, landmark legislation that would require private health plans covering sex-rejecting procedures to also cover restorative care for individuals who experience complications, adverse effects, or later seek to restore bodily function. Senator Roger Marshall (R-KS) is leading the companion legislation in the Senate.
The TRUTH in Coverage Act establishes a straightforward principle of fairness: if an insurance plan covers sex-rejecting medical procedures, it should also cover treatment to address the resulting harms and restore healthy human form and functioning, to the greatest extent practicable. The legislation would require fairness in coverage so that restorative care is not subjected to more restrictive deductibles, copayments, prior authorization requirements, or other limitations than the procedures themselves.
Both medical organizations, the American College of Pediatricians (ACPeds) and Do No Harm, are supportive of the TRUTH in Coverage Act. They have released the following statements:
Dr. Michael Artigues, President of ACPeds:
“Patients who experience serious complications or later seek restorative care should never be abandoned by the very insurance plans that paid for the original sex-rejecting procedures. The TRUTH in Coverage Act promotes fairness, transparency, and accountability by ensuring patients have access to health care to address complications and restore healthy bodily function to the greatest extent practicable. Every patient deserves continuity of care and access to restorative care.”
Dr. Kurt Miceli, Chief Medical Officer at Do No Harm:
“The TRUTH in Coverage Act will be a relief to those who’ve had their bodies altered and lives ruined by sex-rejecting procedures. We must publicly acknowledge the plight of detransitioners and this law will help those who regret undergoing these procedures to restore their bodies, to the greatest extent practicable.”
Chloe Cole, a victim of the child sex-change industry and advocate on behalf of other gender-transitioned children and their families seeking accountability:
“I have experienced first-hand the destruction that the gender transitioning industry can wreck on children. I thank Representative Diana Harshbarger for the TRUTH in Coverage Act, which requires private health plans covering sex-rejecting procedures to also cover restorative care for detransitioners. Kids suffering the harms of sex-rejecting procedures deserve financial access to medical treatments that would reverse those effects.”
Dr. Michelle Cretella, Adolescent Health Council Co-Chair at ACPeds:
“The TRUTH in Coverage Act is a matter of long-overdue justice. ACPeds believes children deserve compassionate, evidence-based care that prioritizes their long-term health and well-being. Puberty blockers, cross-sex hormones, and cross-sex surgeries can cause lasting harm across multiple organ systems, yet for more than a decade many insurance companies have covered these procedures while denying coverage for restorative counseling, medications, and surgeries when patients later seek care for complications or to restore healthy bodily function. No insurer should profit from covering life-altering procedures while refusing to cover the care patients need when they seek restorative care. The TRUTH in Coverage Act is the first step to remedy this injustice and ACPeds urges Congress to advance this legislation.”
The legislation applies to private health plans governed by the Public Health Service Act, ERISA, and the Internal Revenue Code. It would require coverage for a broad range of restorative services, including treatment for endocrine dysfunction, reproductive injury, surgical complications, rehabilitation, mental health conditions associated with prior procedures, reconstructive care, long-term medical surveillance, and fertility-restoration services that seek to restore normal reproductive function. The bill would take effect for plan years beginning on or after January 1, 2027.
